The decision and discretion of Midtown Vacation Private Limited in regard to the eligibility of any purchaser for being considered for the Vacation Ownership shall be absolute and beyond contest.

Any query submitted through the form on the website can be replied to by our Customer Care Team either over call or email.

Unless specifically mentioned, the following expenses are not included in the purchase of Vacation Ownership:

• SPA / Beauty Salon
• Food and beverage
• Sightseeing
• Medical Services
• GST
• Travel Insurance
• Transportation of any kind
• Visa
• All other expenses unless specified or any expense of personal nature

• Accommodation will be provided only to the number of individuals as permissible/requested and provided for in the opted category.
• An Electronic Confirmation (e-CV) will be sent to the email address registered with us.
• To honour the reservation, please carry the confirmation along with a valid government photo identity proof at the time of check-in at the resort.
• We do not offer or guarantee booking from 20 December to 5 January every year.
• Midtown Vacation Private Limited shall provide alternate accommodation in another resort/hotel if, for any reason, it is unable to provide the Vacation Ownership accommodation in the allotted resort before or after issuance of confirmation.
• Resorts shown on the website may change on a regular basis.
• Midtown Vacation Private Limited reserves the right to add or remove any resort from its list at its sole discretion. The listing of a resort does not guarantee booking against a requisition.

Vacation owners can exchange their entitled week with Midtown Vacation Private Limited's current associate resorts for the year in which the member wishes to take the vacation without any exchange fee.

Apart from current associate resorts, members can utilize different hotels and resorts by paying the applicable exchange fee.

Midtown Vacation Private Limited provides an option to instantly convert the payment towards the product price into EMI options at applicable rates for selected banks, subject to the terms and conditions of the respective bank.

Charges applicable on EMI depend on the policies of the respective banks.

Availability of resorts and bookings is subject to change from time to time and can be confirmed based on real-time online availability.

No request for transfer of confirmation shall be entertained by Midtown Vacation Private Limited.

The purchaser understands the terms and conditions of the special enrolment offer(s) chosen at the time of booking the Midtown Vacation Private Limited package.

Any payment made by the purchaser would be appropriated towards the purchase fee and the balance, if any, would be payable towards the entitlement.

Any part payment made towards an outstanding amount shall first be appropriated towards interest and then towards earlier dues/outstanding.

The purchaser confirms that there are no verbal or written promises or any other assurances not mentioned in the Vacation rules made by the personnel of Midtown Vacation Private Limited.

The purchaser agrees to indemnify and keep indemnified Midtown Vacation Private Limited against any loss, damage, claims, costs and expenses which may be incurred or suffered by Midtown Vacation Private Limited in respect of the availability of Vacation under this offer.

If you suffer injury, illness or death directly as a result of the services provided as part of your holiday, the company is not liable to make any payment to you.

No payment will be made if the injury, illness or death was caused by an event or circumstances which the person who caused it could not have predicted or avoided even if all necessary and due care had been taken.

No payment will be made if the illness, injury or death was your own fault.

You should cooperate fully with the company if it or its insurers want to enforce those rights.

If you or someone on your holiday booking is injured, falls ill or dies while taking part in an activity which is not part of the vacations, or you incur unpredictable extra expenses for which the company is not liable because the event is beyond its control, the company will, where appropriate and subject to its discretion, try to help where possible.

You must make a claim under your insurance policy's legal expenses or other appropriate section.

The company reserves the right to refuse to accept you as a customer or continue dealing with you if the company, or another person in authority, believes your behaviour:

• Is disruptive or causes unnecessary inconvenience
• Is threatening or abusive
• Causes damage to property
• Upsets, annoys or disturbs other travellers
• Puts other travellers, staff or agents at risk or in danger

This applies to behaviour on the telephone, in writing or in person.

If resort staff or agents believe that you could be disruptive or that you are suffering from a contagious disease, they may refuse to let you proceed with travel arrangements, restrict your movements, or remove you from your accommodation or excursion.

If this occurs overseas, you will become responsible for your own return home and for any members of your group who cannot or will not travel without you. The company will not be liable for any refund, compensation, costs or expenses incurred.

If accommodation is refused because of your behaviour or because you are under the influence of alcohol or drugs, the resort may pass your details and the date of refusal to other resorts for their information.

In these circumstances no refunds or compensation will be paid, and a claim may be made against you for damages, costs and expenses, including legal expenses, resulting from your behaviour. This may include repairing or replacing property, compensating persons affected by your actions, and criminal proceedings.

For the purposes of this section, references to “you” or “your” include any other person in your group.

Midtown Vacation Private Limited is engaged in the business of Vacation Ownership.

Customers are requested to review travel warnings, announcements, advisories and prohibitions issued by relevant authorities and governments before confirming international bookings.

By offering travel products for particular destinations, Midtown Vacation Private Limited does not warrant that travel to such areas is advisable or without risk and is not liable for damages or losses that may result from travel to such destinations.

It is a condition of booking that you and all members of your party provide certain information that may be sent to governmental authorities, border control and security agencies for security and counter-terrorism purposes.

This is known as Passenger Name Records data and/or Advanced Passenger Information.

Information that may be required includes:

• Gender
• Date of birth
• Travel document type
• Travel document number
• Country of issue
• Expiry date
• Country of residence
• Address for your stay
